Terms of Service

These Terms govern your access to and use of the Kiteum Edu platform, including all features for institution management, student records, admissions, attendance, examinations, and AI-powered tools.

Introduction

Welcome to Kiteum Edu. These Terms of Service form a legally binding agreement between Kiteum Edu ("Kiteum", "we", "our") and the institution or individual ("you", "institution") accessing or using the Platform. Kiteum Edu is an AI-powered educational institution management platform built for schools, colleges, and coaching centres across India, offering tools for admissions, attendance, examination management, fee collection, staff and student management, communication, and AI-powered support.

Acceptance of Terms

By accessing, registering, or using the Kiteum Edu platform ("Platform"), you โ€” whether as an institution administrator, staff member, teacher, student, or parent โ€” agree to be legally bound by these Terms of Service ("Terms").

If you are registering on behalf of an educational institution, you represent that you have the authority to bind that institution to these Terms. If you do not agree with any part of these Terms, you must immediately stop using the Platform.

Use of the Platform by minors (persons under 18) must be supervised by and conducted under the authority of a registered institution administrator or a parent/guardian.

Accounts & Registration

Institutions must complete the registration process at edu.kiteum.com/initial-setup, providing accurate and complete information including institution name, type, address, contact details, and a valid logo. Kiteum reserves the right to reject or remove registrations that contain false or misleading information.

Each institution is responsible for maintaining the confidentiality of its login credentials. You must immediately notify Kiteum of any unauthorised access or suspected breach of your account.

Institution accounts may create sub-accounts for administrators, teachers, staff, and students. The institution is responsible for all activities conducted under accounts it creates, and must ensure that all users comply with these Terms.

You agree to provide accurate, current, and complete information and to update it as necessary. Kiteum may suspend or terminate accounts where inaccurate information is detected.

Consent & Pending Accounts: When an institution adds a student or staff member to the Platform, Kiteum automatically sends a consent request to that individual or their parent/guardian. The institution administrator may continue to manage that individual's records (attendance, fees, examinations) while consent is pending. However, by doing so, the institution accepts full legal responsibility for processing that individual's personal data without confirmed consent, and agrees to indemnify and hold Kiteum harmless from any claims, penalties, or legal proceedings arising from the absence of confirmed consent from that individual.

Institutions are responsible for providing accurate contact details (email or phone) for every user they add, to ensure consent requests are successfully delivered. Where a user cannot be reached electronically, the institution must obtain physical written consent and retain a record of it. Kiteum's dashboard displays a 'Consent Pending' status for all users who have not yet responded, and institutions are strongly advised to resolve all pending consents promptly.

Acceptable Use

You may use the Platform solely for lawful educational management purposes, including admissions, attendance tracking, examination management, fee collection, communication, and academic record maintenance.

You must not: attempt to gain unauthorised access to any part of the Platform; upload or transmit malicious code, viruses, or harmful content; use the Platform to harass, abuse, or harm any individual; scrape, copy, or redistribute Platform data without authorisation; impersonate any person, institution, or entity; use the Platform for any commercial purpose unrelated to your institution's educational operations.

Kiteum reserves the right to investigate suspected violations and to take appropriate action, including account suspension, data removal, or referral to law enforcement authorities.

Content uploaded to the Platform, including student records, documents, and communications, must comply with applicable laws including the Information Technology Act, 2000 (India) and other relevant data protection regulations.

Subscriptions & Payments

Kiteum Edu offers a free trial period of 30 days from the date of institution registration, providing full access to all Platform features. No credit card is required to begin the trial.

Following the trial period, continued access to the Platform requires a paid subscription. Subscription plans, pricing, and feature inclusions are described on the pricing page at edu.kiteum.com/pricing, and are subject to change with reasonable notice.

All fees are quoted in Indian Rupees (INR) unless otherwise stated. Payments must be made in advance for the selected billing period. Kiteum uses third-party payment processors and does not store complete payment card information.

Subscriptions automatically renew unless cancelled at least 7 days before the renewal date. Refunds are not provided for partial billing periods except where required by applicable law. In the event of a billing dispute, institutions must contact support within 30 days of the charge.

Data Ownership & Usage

All student records, academic data, attendance records, fee records, and institutional data uploaded to or generated within the Platform remain the sole property of the respective institution. Kiteum does not claim ownership over institution or student data.

By using the Platform, institutions grant Kiteum a limited, non-exclusive licence to process, store, and transmit data solely for the purpose of providing and improving the Platform services.

Kiteum will not sell, share, or disclose institution or student data to third parties for marketing or commercial purposes. Data may be shared with third-party service providers (e.g., cloud infrastructure, payment processors) solely to operate the Platform, under strict confidentiality obligations.

Upon termination of a subscription, institutions may request a full data export within 60 days. After this period, Kiteum may permanently delete institution data from its systems.

Service Availability

Kiteum aims to provide reliable, high-availability services. However, we do not guarantee uninterrupted, error-free operation of the Platform. Scheduled maintenance, updates, and unforeseen outages may result in temporary unavailability.

Kiteum will endeavour to provide advance notice of planned maintenance that may affect Platform availability. Emergency maintenance may be carried out without prior notice where necessary to protect Platform security or integrity.

In the event of data loss caused by Kiteum's infrastructure failures, Kiteum will use reasonable efforts to restore data from the most recent backup. However, Kiteum does not guarantee complete data recovery in all circumstances and recommends that institutions maintain their own backups of critical data.

AI Features & Chatbot

The Platform includes AI-powered features including a 24/7 AI chatbot for student, parent, and staff support, and AI-assisted document and report generation. These features are provided to augment, not replace, human judgement and institutional decision-making.

AI-generated content, reports, or recommendations provided by the Platform should be reviewed by an authorised human before being used for official purposes. Kiteum does not guarantee the accuracy, completeness, or fitness of AI-generated outputs for any specific purpose.

Institutions are responsible for ensuring that use of AI features complies with applicable laws, and for obtaining any necessary consents from students, parents, or staff where AI processing involves personal data.

Termination

Either party may terminate the agreement at any time. Institutions may cancel their subscription by contacting support. Kiteum may terminate or suspend access immediately and without notice if an institution materially breaches these Terms, fails to pay applicable fees, or engages in conduct that poses a risk to other users or the Platform.

Upon termination, the institution's right to access the Platform ceases immediately. Kiteum will retain institution data for 60 days following termination to allow for data export requests, after which data may be permanently deleted.

Termination does not relieve institutions of any payment obligations that accrued prior to termination. Provisions of these Terms that by their nature should survive termination (including data ownership, limitation of liability, and dispute resolution) shall continue in effect.

Kiteum's support team is available during business hours (Monday to Saturday, 9:00 AM to 6:00 PM IST). The AI chatbot is available 24/7 for general queries.

For legal notices, institutions should contact Kiteum in writing at the address listed on the official website. Legal notices sent by email will be acknowledged but may not constitute formal legal service.

Limitation of Liability

To the fullest extent permitted under applicable Indian law, Kiteum's aggregate liability to any institution or user for any claim arising out of or relating to the Platform shall not exceed the total fees paid by that institution to Kiteum in the 12 months preceding the claim. Kiteum shall not be liable for any indirect, incidental, special, consequential, or punitive damages including loss of data, revenue, or business opportunity, arising from use of or inability to use the Platform, even if advised of the possibility of such damages.

Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in India. Kiteum encourages institutions to resolve disputes informally by contacting support before initiating legal proceedings.

Changes to These Terms

Kiteum may revise these Terms from time to time. When changes are made, the updated Terms will be posted at edu.kiteum.com/terms with a revised "Last Updated" date. For material changes, Kiteum will notify registered institutions by email or through an in-Platform notice at least 14 days before the changes take effect. Continued use of the Platform after the effective date constitutes acceptance of the revised Terms.
